Limited Warranties
The following Limited Warranties are granted solely to the original retail purchaser, subject to all the terms and conditions below. These Limited Warranties are non-transferable.
Ashley Furniture Industries, LLC (“Ashley”), subject to all limitations and exclusions described in these Limited Warranties, warrants the following Ashley products and parts against manufacturing defects in materials for the duration indicated next to that product or part in the table below.
All warranty periods begin on the date of delivery of the product.
*As used in these Limited Warranties, “useful life” means the normal useful life of the product under reasonable use.
**After the first year of use, Ashley will replace the sleeping mattress on the following pro-rata basis: more than 1 but less than 2 years of use, 90% of the replacement cost is covered; more than 2 years but less than 3 years of use, 80% of the replacement cost is covered.
***All seat cushion cores, both in Non-Adhered and Attached Cushions, will soften with normal use and adapt to the user's shape. This will be considered normal wear and tear and will not be considered a loss of resilience or a manufacturing defect.
The Limited Warranty for Leather and Upholstery Fabric also covers seam slippage, cracking, and dye transfer. Leather is a natural product, and as such, each hide will reflect its own individuality. Some variations in tone and shade are to be expected, as well as the marks, scratches, and creases that only occur on genuine leather; these characteristics should not be considered a defect in any way. These Limited Warranties do not cover tearing, surface flattening, pilling, fading, or shrinkage and are void where there is evidence of heavy soiling or abuse. These Limited Warranties also do not cover protective finishes, velvets, and velvet types, as by their nature, these fabrics are soft in texture and will flatten, shade, and mark more easily than most fabrics; these characteristics should not be considered a defect in any way.
LIMITATIONS AND EXCEPTIONS
The following limitations and exceptions apply to the Limited Warranties:
Remedy
Under these Limited Guarantees, for all products other than unattached cushions (as defined in the subject heading “Cushioning”), Ashley’s sole liability is limited to the repair, or at its option the replacement, of the product or applicable part that, upon examination by an authorized Ashley manufacturer representative, is found to have a material manufacturing defect. NO REFUNDS ARE AVAILABLE. If, during the warranty period, identical materials are not available at the time of repair or replacement, Ashley reserves the right to substitute materials of equal or superior quality. Replacement fabrics may vary in color from the original due to dye lot differences.
In addition, during the period of any applicable Labor Coverage, Ashley will pay, within one year of the delivery date, reasonable and customary labor rates to repair or replace defective parts (at Ashley's option) and shipping costs from the retailer to Ashley and vice versa, at no cost to the original retail purchaser. After the expiration of Labor Coverage or for all products or parts not covered by Labor Coverage, the original retail purchaser will be responsible for labor, packaging, and all shipping and transportation costs. Costs associated with transporting the furniture or parts from your home to the retailer or from the retailer to your home are excluded from all Limited Warranties.
For loose cushions with a material manufacturing defect, Ashley will replace the defective loose cushion provided that the original retail purchaser during the warranty period (i) complies with the claim procedure set forth in these limited warranties, and (ii) if requested by Ashley, returns the defective cushion core contained in a loose cushion to Ashley Furniture Industries, LLC, Attn: Director of Quality, One Ashley Way, Arcadia, WI 54612. The remedy specified in this paragraph is Ashley's sole liability related to loose cushions.
Any item repaired or replaced under these Limited Warranties will be covered by the Limited Warranties for the remainder of the original warranty period only.
All products
These Limited Warranties do not apply to (i) rented, commercial, institutional, or other non-residential uses, (ii) merchandise that was ever used as a floor sample or display model, (iii) any merchandise purchased "as is" or secondhand, (iv) any merchandise purchased in a liquidation sale or a business closure sale, (v) any merchandise purchased from a liquidator, or (vi) merchandise obtained from a rental retailer. All warranties, whether express or implied, cover only normal household use. No warranty, express or implied, applies to any condition resulting from misuse, abuse, damage during delivery or transport, or any condition resulting from improper or inadequate maintenance, cleaning, or care. These Limited Warranties are void if the furniture has been moved from the original point of delivery to the consumer.
Chemical treatments
These limited warranties do not cover damage or defects caused by the use of chemical treatments or protective coatings on the finish, leather, or upholstery fabric by the retailer or original retail purchaser, and such chemical treatments or protective coatings void all Ashley warranties.
Leather, upholstery fabric and finishes
The limited warranties for "Leather," "Upholstered Fabric," and "Finishes and all other furniture products" do not cover (i) damage resulting from excessive soiling or improper or unapproved cleaning methods, (ii) fading or other damage resulting from exposure to sunlight, (iii) damage resulting from household humidity, or (iv) damage resulting from any liquid, including but not limited to alcohol and water. Caution: Any use of improper or unapproved cleaning methods voids all Ashley warranties.
Product Modifications
These Limited Warranties do not apply to any product that has been altered by any person, distributor, or company without Ashley's express written authorization.
Guarantees Involved
IMPLIED WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE IMPOSED ON THE SALE OF THIS FURNITURE AND ITS PARTS UNDER STATE LAW, ARE LIMITED IN DURATION TO THE DURATION OF THE APPLICABLE WARRANTY FOR THE PRODUCT OR PART AND NO WARRANTIES APPLY AFTER THAT PERIOD. SOME STATES DO NOT ALLOW LIMITATIONS AS TO HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
DISCLAIMER
NO OTHER EXPRESS WARRANTY HAS BEEN OR WILL BE MADE ON BEHALF OF ASHLEY WITH RESPECT TO THE FURNITURE AND ITS PARTS, OR THE OPERATION, REPAIR, OR REPLACEMENT OF THE FURNITURE AND ITS PARTS. FURTHERMORE, NO REPRESENTATIVE OF ASHLEY OR ITS DEALERS OR RETAILERS IS AUTHORIZED TO MAKE ANY CHANGES OR MODIFICATIONS TO THESE LIMITED WARRANTIES.
SOME RETAILERS OFFER EXTENDED OR ADDITIONAL WARRANTIES, INCLUDING BUT NOT LIMITED TO EXTENDED OR ADDITIONAL FABRIC WARRANTIES, EITHER FROM THE RETAILER OR THROUGH A THIRD PARTY. ASHLEY WILL NOT BE LIABLE UNDER ANY EXTENDED OR ADDITIONAL WARRANTY OFFERED BY ANY RETAILER OR THROUGH A THIRD PARTY UNDER ANY CIRCUMSTANCES.
IN NO EVENT SHALL ASHLEY BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SUCH AS LOSS OF USE, INCONVENIENCE, LOSS OF OR DAMAGE TO PERSONAL PROPERTY, WHETHER DIRECT OR INDIRECT, AND WHETHER ARISING IN CONTRACT OR TORT, EVEN IF ASHLEY HAD REASON TO KNOW IN ADVANCE THAT SUCH DAMAGES WERE POSSIBLE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
IN NO EVENT SHALL ASHLEY'S LIABILITY EXCEED THE PURCHASE PRICE OF THE PRODUCT OR ITS REPLACEMENT.
This guarantee gives you specific legal rights, and you may also have other rights that vary from state to state.
CAUTION
Movable furniture (recliners, sofa beds, etc.) has many moving parts. Caution should be exercised when operating them (opening, closing, etc.). Children should not be allowed to play with or operate movable furniture. Always leave recliners in the upright, closed position and keep your hands and feet clear of the mechanism. Only the occupant should operate it.
COMPLAINT PROCEDURE
To obtain warranty services, the original retail purchaser must comply with the requirements of this Claim Procedure.
Contact the Ashley retailer where you purchased your furniture for warranty service. All claims must include the original sales receipt, the product serial number, and be submitted within the applicable warranty period. Ashley reserves the right to require defective parts to be returned upon request. You must arrange with the retailer to schedule the transport of the furniture or parts from your home to the retailer or from the retailer to your home. If the retailer where you purchased the furniture has closed and you require service, please contact Ashley in writing or call our Customer Service.

Remedy
Under these Limited Warranties, Ashley's sole obligation during the applicable warranty period is to repair or replace, at its option, upon examination by an authorized Ashley representative, any product or applicable part that does not conform to these Limited Warranties. After 1 year, the limited warranties for the Electrical Foundation Frame and Electrical Foundation Mechanism cover only replacement parts. NO REFUNDS ARE AVAILABLE. If, during the warranty period, identical materials are not available at the time of repair or replacement, Ashley reserves the right to substitute materials of equal or superior quality.
In addition, during the period of any applicable Workers' Compensation Coverage, Ashley will pay reasonable and customary labor rates to repair or replace defective parts (at Ashley's option) and shipping costs to and from the retailer, at no cost to the original purchaser. After the expiration of the Workers' Compensation Coverage or for all products or parts not covered by the Workers' Compensation Coverage, the original purchaser will be responsible for labor, packaging, and all shipping and transportation costs.
These Limited Warranties do not apply to commercial, institutional, business, or other non-residential uses. These Limited Warranties do not apply to (i) merchandise that has at any time been used as a floor sample or display model, (ii) merchandise purchased "as is" or secondhand, (iii) merchandise purchased at a liquidation or business closure sale, or (iv) merchandise purchased from a liquidator. All warranties, whether express or implied, cover only normal household use. No warranty, express or implied, applies to any condition resulting from improper use, abuse, damage during delivery or transport, or any condition resulting from improper or inadequate maintenance, cleaning, or care. These Limited Warranties are void if the product has been damaged in transit from the original point of delivery.

These Limited Warranties do not apply to any product that has been altered by any person, distributor, or company without Ashley's express written authorization.
Limitations and Exceptions
These Limited Warranties do not cover the following:
• Stains on the fabric, dirt and burns.
• The edge cables, which run around the perimeter of the mattress or bed frame, bend due to movement or flexing.
• Structural damage to a mattress caused by the use of an unsuitable bed frame or base.
The mattress must be continuously supported by a suitable base with an appropriate bed frame. An appropriate bed frame must fully support the base. These Limited Warranties apply to queen and king size mattresses and bases only when used on an appropriate bed frame with a rigid center support having at least 5 legs and 3 cross slats.
• A mattress or support that is not defective.
• Normal body impressions on a memory foam or gel mattress less than three-quarters of an inch (3/4″) deep.
• Normal body impressions on an internal spring mattress less than one and a half inches (1½″) deep.
• Height of the bed with mattress and base or fully assembled bed frame.
• The zippered mattress cover more than two (2) years after the delivery date.
• Comfort preference.
• Blade adjustment.
• Transportation costs.
Implied Guarantees
IMPLIED WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, IMPOSED ON THE SALE OF THIS PRODUCT AND ITS PARTS UNDER STATE LAW, ARE LIMITED IN DURATION TO THE WARRANTY PERIOD AND NO WARRANTIES APPLY AFTER THAT PERIOD. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

ASHLEY WILL NOT BE LIABLE UNDER ANY EXTENDED OR ADDITIONAL WARRANTY OFFERED BY ANY RETAILER OR THROUGH A THIRD PARTY UNDER ANY CIRCUMSTANCES.
THE TERMS AND CONDITIONS SET FORTH IN THESE LIMITED WARRANTIES SHALL BE THE CONSUMER'S SOLE AND EXCLUSIVE REMEDY FOR ANY MANUFACTURING DEFECT DURING THE WARRANTY PERIOD. IN NO EVENT SHALL ASHLEY BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY, OR SIMILAR DAMAGES, WHETHER DIRECT OR INDIRECT, AND WHETHER ARISING IN CONTRACT OR TORT.
IN NO EVENT SHALL ASHLEY'S LIABILITY BE EXCEPT ITS EXCLUSIVE OBLIGATION TO REPAIR OR REPLACE THE PRODUCT. IN NO EVENT SHALL ASHLEY'S LIABILITY EXCEED THE PURCHASE PRICE OF THE PRODUCT OR ITS REPLACEMENT. THIS EXCLUSIVE REMEDY SHALL NOT BE DEEMED TO HAVE FAILED OF ITS ESSENTIAL PURPOSE IF ASHLEY IS WILLING AND ABLE TO REPAIR OR REPLACE ANY PRODUCT THAT, UPON EXAMINATION BY AN AUTHORIZED ASHLEY REPRESENTATIVE, IS FOUND TO CONTAIN A MATERIAL MANUFACTURING DEFECT DURING THE LIMITED WARRANTY PERIOD. Some states do not allow the exclusion or limitation of certain damages, so the above limitation or exclusion may not apply to you.
If you use an inappropriate base or box spring with this mattress, its use will void these limited warranties. Ashley reserves the right to discontinue items and change product specifications without prior notice.
Ashley does not guarantee that any product is suitable for any person's medical condition. Ashley offers no warranty beyond that contained in these Limited Warranties.

Complaint Procedure
If a problem arises that you believe is covered by this Limited Warranty, contact the authorized Ashley retailer from whom you purchased the product. All claims must include the original sales receipt, the product serial number, and the legal tag (of the mattress and/or base) and must be submitted within the applicable warranty period to meet the requirements of the Limited Warranty. Ashley may require you to provide proof of the quality of the base used with your mattress. If necessary, the retailer will contact Ashley to arrange service. If the problem can be easily corrected, Ashley will authorize the retailer to perform those repairs. Ashley reserves the right to require the return of defective parts upon request.
Ashley is not responsible for scheduling or the cost of shipping the product from your home to the retailer or from the retailer to your home. You must make those arrangements with the retailer. Caution
The power base has many moving parts. Caution should be exercised when operating it. Children should not play with or operate the power base. Always leave the power base in a flat position and keep hands, fingers, and other body parts away from the mechanism.
Ashley reserves the right to refuse service and void this Limited Warranty if, upon inspection, the mattress or base is found to be in unsanitary condition or if the product failure is due to causes other than defective workmanship or materials. Please refer to the "Mattress and Base Care Instructions" section of this Limited Warranty for proper care of your mattress and base.
