COMMERCIAL CONDITIONS AND AUTHORIZATION FOR THE PROCESSING OF PERSONAL DATA (HABEAS DATA)
1. Product prices do not include delivery or installation unless these services are properly itemized in the order or invoice. The scope of delivery and installation services may vary depending on the type of service purchased.
2. Deliveries are only made under "normal" conditions or those agreed upon in the access dimensions template. The customer is responsible for resolving unexpected situations such as lifting products up the facade in case of narrow stairs, small elevators, among others.
3. Shipments and installations will be scheduled according to availability at the time. Shipping and installation service prices include only one (1) delivery transport per order. Installers and the carrier will wait a maximum of fifteen (15) minutes. If no one is at the delivery site and/or the delivery is canceled before delivery, the delivery must be rescheduled
. The customer will assume the cost of transportation and installation for the next delivery. If you are unable to attend delivery of your product, please call the store where you purchased it and notify us before 12:00 pm on the business day prior to delivery. This will avoid shipping costs. See store details for costs.
4. Costs and risks for packaging, shipping, and insurance for shipments not made by Clover4 SAS are the customer's responsibility.
5. Send proof of payment toexperience@ashleycolombia.com. Payments will be processed when the amount is available through our payment channels, fulfilling the requirement to schedule delivery or installation, if purchased.
6. Clover4 SAS is not responsible for damage to water or electrical pipes or other installations attached to the wall or floor, the existence of which has not been reported by the customer in writing to Clover4 SAS prior to installation. Therefore, Clover4 is not responsible for any costs or damages incurred in this event.
7. Once the customer is informed that the furniture and/or accessories are ready to be shipped, the customer has a period of ten (10) days to receive the merchandise. If after this period of time the customer does not receive the furniture and/or accessories,
accessories, the client will incur an additional cost of three percent (3%) per month of the total sales price of the furniture and/or accessories as a storage surcharge and proportional according to the number of days in which the client does not coordinate the dispatch. This surcharge will have to be paid by the customer before sending the products. If the storage of the furniture and/or accessories is carried out in a warehouse other than Clover4 SAS, the client must assume the corresponding warehousing costs and in any case should be responsible for this value since the corporate purpose of Clover4 SAS does not consist of providing storage or deposit services to clients of the products it markets, which constitutes a contract substantially different from the purchase and sale contract. If the customer takes more than fifteen (15) days to coordinate the delivery, the furniture and/or accessories may be released for sale, and the customer will be left with a voucher for the amount paid in the order less the storage cost during the time that the furniture and/or accessories were reserved, as well as the value of the 'restocking fee'.
8. If, after placing an order, the customer decides to cancel it in whole or in part, Clover4 SAS will charge the customer 50% of the value of the furniture and/or accessories subject to cancellation as damages.
9. The customer acknowledges and accepts that after receiving the furniture and/or accessories to their complete satisfaction, returns will not be accepted. In any case, if the customer decides to return the furniture and/or accessories after receiving them to their satisfaction, Clover4 SAS will charge the customer 50% of the total value of the returned furniture and/or accessories as damages, provided that the furniture and/or accessories are not damaged or defective.
10. Clover4 SAS estimates that it will deliver the furniture and/or accessories within the timeframes stipulated on the back of this sheet. However, the customer acknowledges and accepts that, as this is the sale of imported and exclusive furniture and/or accessories, any of the following events listed below may occur and are beyond the control of Clover4 SAS:
a) The furniture and/or accessories ordered by the buyer may be discontinued in the country of production or export. In this case, the customer may choose other furniture
and/or accessories or cancel the order. If any payment has been made, Clover4 SAS will refund the customer.
b) The production of furniture and/or accessories requested by the buyer is stopped in the country where it is produced, in which case the client agrees to wait until the production of furniture and/or accessories is resumed in the country where it is produced and once production is resumed, Clover4 SAS will inform the buyer.
c) In the event that customs temporarily does not allow the entry of furniture and/or accessories by Clover4 SAS into
Colombian territory or for any reason prevents the imported furniture and/or accessories from arriving in the country on the established date,
both Clover4 SAS and the client, because it is a decision by an authority, know and accept that they must wait for
the Customs Authorities to allow the entry of furniture and/or accessories into Colombian territory.
The client will have the option to cancel the purchase order, knowing that they must recognize and pay Clover4 SAS 50% of the sale value as damages at the time of cancellation.
11. Furniture and/or accessories purchased by the customer at a discount cannot be returned or exchanged; When purchasing them, the buyer knows that the furniture and/or accessories may have possible deterioration and/or defects.
12. Clover4 SAS offers a one (1) year warranty on all its products in case of manufacturing defects or defects in materials. In these cases, Clover4 SAS will, at its discretion, repair or replace the product in full or in part. Damage and defects caused by accidents, negligence, irregular use, or failure to follow the assembly instructions and product care guide will not be subject to claims.

14. The customer authorizes the brand to send communications, including news, marketing campaign information, and/or invitations to events that may be of interest. This communication will be sent to the email address, and the customer may be contacted through any other means provided at the time of purchase.
15. Any matter not expressly provided for in the commercial conditions previously stipulated by Clover4 SAS is established in accordance with the regulations of the Commercial Code that regulate sales, articles 905 to 967, and taking into account the corporate purpose of Clover4 SAS.
16. For products corresponding to the Black Friday promotion, exchanges or returns are not accepted.
